Privacy Policy
Mystery Shopping Academy ("we," "us," or "our") is the trade name of Tower Digital Media LLC, an Arizona limited liability company. We respect the privacy of the visitors and customers of our website and programs. This policy explains what information we collect, why we collect it, who we share it with, and what choices you have.
We have written this in plain language rather than legal boilerplate, and we have tried to describe what we actually do rather than everything we might theoretically be permitted to do. If anything here is unclear, email us and we will explain it.
1. What This Policy Covers
This policy covers learnmysteryshopping.com, the Mystery Shopping Academy and Society program, our email and text communications, and our webinars and live coaching sessions.
It does not cover third-party websites or platforms we link to. Each of those has its own privacy practices, and we encourage you to review them.
Mystery Shopping Academy is currently the only consumer-facing business operated by Tower Digital Media LLC. If that changes, any other property will have its own separate privacy policy and will not be covered by this one.
2. Information We Collect
2.1 Information you give us
We collect information you provide directly, including:
- Your name and email address when you register for a webinar, join our email list, or create an account
- Your phone number, if you choose to provide it for text messages
- Your billing address and country of residence at checkout
- Questions, messages, and support requests you send us
- Responses to surveys, polls, and questions asked during live coaching calls
2.2 Payment information
We do not collect or store your credit or debit card number. Card details are entered by you directly into our payment processors and are handled entirely by them. Your card number is never visible to us.
Payments are processed by Kajabi and its payment providers, and by Klarna or Afterpay if you choose a payment plan. Those companies collect and store your card information directly and are responsible for securing it under their own policies and applicable payment-card security standards.
What we receive back from them is limited: your name, billing address, the last four digits of your card, the card brand, the transaction amount, and whether the payment succeeded or failed. That is the entirety of the payment data available to us.
2.3 Information collected automatically
When you visit our website, we and our analytics and advertising providers automatically collect:
- Your IP address and approximate location derived from it
- Browser type, device type, operating system, and screen size
- Pages you viewed, the order you viewed them in, and how long you stayed
- The website or advertisement that referred you to us
- Whether you opened our emails and which links you clicked
2.4 Cookies and similar technologies
We use cookies โ small text files stored by your browser โ along with pixels and similar technologies. We use them to keep you logged in, remember your preferences, measure how the site is used, and deliver and measure advertising.
You can refuse or delete cookies through your browser settings. If you block cookies, parts of the site, including your account login, may not work correctly.
3. How We Use Your Information
We use the information we collect to:
- Give you access to the Academy and deliver the training, coaching calls, and resources you purchased
- Process your payment and send receipts and billing notices
- Send webinar registrations, reminders, and replay links
- Respond to your questions and provide support
- Send educational content, program updates, and promotional offers, subject to your consent where required
- Measure and improve our website, our training, and our advertising
- Detect and prevent fraud, account sharing, unauthorized content distribution, and abuse
- Comply with tax, accounting, and other legal obligations
4. Advertising and Analytics
We do not sell your personal information for money. We have never done so and we do not intend to.
We do want to be straightforward about something a simple "we don't sell your data" statement would gloss over.
We advertise our programs on Meta platforms (Facebook and Instagram) and we use the Meta pixel on our website. We also use Google Analytics to understand how visitors use the site. These tools transmit information about your visit โ such as your IP address, the pages you viewed, and whether you registered or purchased โ to Meta and Google, who use it to measure our advertising and to show our ads to people with similar interests.
Several U.S. state privacy laws define this kind of transfer as "sharing" for targeted advertising, and some define it as a "sale" even when no money changes hands. Rather than rely on the narrower everyday meaning of the word, we are telling you plainly that this sharing happens, what it is for, and how to stop it.
You can limit this in several ways: adjust your ad preferences directly with Meta, install the Google Analytics opt-out browser add-on, enable your browser's "Do Not Track" or global privacy control setting, or block cookies as described in section 2.4. You may also email us and we will remove you from our advertising audiences.
5. Text Messages
If you provide your mobile number and consent to receive text messages, we may send you webinar reminders, program updates, account notices, and promotional offers about our programs.
We do not share your mobile number, your text-message opt-in, or your consent with any third party for their own marketing purposes. Your mobile opt-in information is used only to deliver our own messages to you.
Consent to receive text messages is never a condition of purchasing anything from us. Message frequency varies. Message and data rates may apply depending on your mobile plan.
To stop receiving texts, reply STOP to any message at any time. To request help, reply HELP or email us. We use a messaging provider to deliver these messages on our behalf; that provider processes your number solely to transmit our messages and is not permitted to use it for anything else. Mobile carriers are not liable for delayed or undelivered messages.
6. Email
When you register for a webinar, join our list, or purchase, you consent to receive email from us about your account, the program, live coaching calls, and our educational content and offers.
Every promotional email includes an unsubscribe link and our mailing address, and you may unsubscribe at any time. Transactional email โ receipts, billing corrections, password resets, and notices about your access โ will continue while your account is active, because those messages are necessary to deliver what you purchased.
7. Live Calls and Webinars
Our live coaching calls and webinars are recorded, and the recordings are made available to enrolled students as replays.
If you join a live session, the recording may capture your display name, your voice if you speak, your video if your camera is on, and anything you type in the chat. Those recordings are shared with other students in the Academy. We do not publish them publicly or use them in advertising without asking you first.
If you would rather not appear, keep your camera and microphone off, use a display name of your choosing, and submit questions through the chat, or simply watch the replay instead. We also collect basic attendance information โ whether you registered, whether you attended, and how long you stayed โ which we use to improve the program and to send replay links.
8. The Student Community
Our private student community is hosted as a Facebook group, not on our own website.
Joining requires an active Facebook account. When you participate, Facebook collects and processes your information under Meta's privacy policy, not this one, and we have no control over that. Group members can see your Facebook profile name, photo, and anything you post. Please treat the group as a semi-public space and avoid posting information you would not want other members to see.
We do not export or repurpose the contents of group discussions. If you post something you want removed, contact a group moderator or email us.
9. Who We Share Information With
We share information only in the circumstances described below.
Service providers. Companies that operate parts of our business on our behalf, including our course platform (Kajabi), payment processors (including Klarna and Afterpay), email and text messaging providers, webinar and video conferencing services, and analytics and advertising platforms. These companies may use your information only to perform services for us.
Advertising platforms. As described in section 4.
Professional advisers. Our accountant, attorney, or auditors, where necessary and under a duty of confidentiality.
Legal requirements. When required by subpoena, court order, or applicable law, or where we reasonably believe disclosure is necessary to investigate fraud, protect our legal rights, or protect the safety of any person.
Business transfer. If the business is sold, merged, or reorganized, customer information may transfer to the acquiring party as part of that transaction.
We do not share your information with third parties for their own independent marketing purposes.
We also do not share it with any other business operated by Tower Digital Media LLC. Information you provide to Mystery Shopping Academy stays with Mystery Shopping Academy and is used only for the purposes described in this policy.
10. How Long We Keep Information
We keep your information for as long as your account is active and for as long afterward as we need it for the purposes described in this policy.
- Transaction and billing records are retained for seven years, to meet tax and accounting requirements.
- Account and course-progress data is retained while your account exists and for a reasonable period after your 92-day access ends.
- Email and text marketing lists are retained until you unsubscribe or ask us to remove you.
- Support correspondence is retained for as long as needed to resolve the matter and maintain a service record.
When information is no longer needed, we delete it or remove the details that identify you.
11. How We Protect Information
Our website and course platform use encrypted connections. Card numbers never reach our systems. Access to customer records is limited to the people who need it to operate the business, and accounts are protected by passwords you choose and control.
No method of transmitting or storing information online is completely secure, and we cannot guarantee absolute security. Please choose a strong, unique password and do not share your login credentials with anyone. If we become aware of a security breach affecting your personal information, we will notify you as required by applicable law.
12. Your Choices
You can do any of the following at any time, and we will act on your request promptly:
- Unsubscribe from marketing email using the link at the bottom of any promotional message
- Stop text messages by replying STOP
- Opt out of advertising as described in section 4
- Ask what information we hold about you
- Correct information that is inaccurate
- Request deletion of your personal information
Email [email protected] for any of these. So that we do not disclose your information to someone else, we may ask you to confirm your request from the email address on your account.
Some information cannot be deleted on request. We are required to retain transaction and tax records for the period described in section 10, and we may retain information necessary to resolve a dispute, prevent fraud, or enforce our Terms. Deleting your account also ends your access to the Academy, and no refund is issued for any remaining access period.
We will not treat you differently, deny you service, or charge you a different price because you exercised any of these choices.
13. Canadian Customers
We are a United States business, and most of our customers are in the United States. If you are in Canada, the following also applies to you.
We collect and use your personal information only with your knowledge and consent, and only for the purposes described in this policy. You may withdraw your consent to marketing email or text messages at any time using the unsubscribe link or by replying STOP, and we will act on that request within ten business days. You may also ask us what personal information we hold about you and request that we correct it, using the contact details in section 17.
Your information is stored in the United States and is subject to United States law, including lawful access requests by United States authorities.
14. Where Information Is Stored
We are based in the United States and our service providers store information on servers located in the United States. If you access our website or purchase from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
Our programs are directed to customers in the United States and Canada. We do not target our advertising or offer our programs to residents of the European Union or the United Kingdom.
15. Children
Our programs are sold only to adults. The minimum age to create an account or purchase is 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, email us and we will delete it.
16. Governing Law
This policy is governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute arising out of or relating to this policy shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.
17. Changes and Contact
We may update this policy as our business or the law changes. The version posted on this page is the version in effect, and the date at the top reflects when it was last revised. If we make a material change to how we handle your information, we will notify account holders by email. This policy replaces the version dated May 21, 2024.
